Crimes of Conscience: Antigone and Stealing from the Public Library

The libraries at the University of Texas at Austin shelve 83 volumes by Ayn Rand. Of them, 30 have been stolen. Of those, eight are marked in the catalog as “Missing.” In other words, they left the shelves without being checked out. The others were just not returned by the last borrowers who effectively got away with their crimes.  I identify these facts as evidence of a deeper political problem, first posited 2500 years ago by Sophocles in his drama, Antigone.  More recent, and known well to admirers of the works of Ayn Rand, are the trial scenes from The Fountainhead and Atlas Shrugged.  Not so famous, but cutting more deeply into the fabric of law is Ayn Rand’s courtroom drama, Night of January 16th. The question is whether or not you have a duty to obey the law.


It is important to understand, first, that Ayn Rand was opposed to duty.
The meaning of the term “duty” is: the moral necessity to perform certain actions for no reason other than obedience to some higher authority, without regard to any personal goal, motive, desire or interest. – “Causality versus Duty,” in Philosophy: Who Needs It?

Obviously, for some admirers of the works of Ayn Rand, the prospect of a free copy of one of her books was stronger than any irrational duty to the public order. However, it is also true that Rand’s dictum above must be placed in its proper context because she was far more eloquent in her condemnation of “looters” and substantially incisive in her praise for their antithesis, the producers.  Moreover, the moral and political aspects of her philosophy of Objectivism were primarily about the positive virtues of production, creation, and active reason, against which are revealed the negative, destructive, and empty actions of the irrational and non-productive.


The essential question here is: “What justifies stealing from the public library?” It leads to a far wider set of questions and actions. I assert that if it is acceptable to steal Atlas Shrugged from the library, then it is acceptable to take a tree from a public park, or a computer from city hall, or the President’s limousine from the White House.  And, ultimately, it would be acceptable to take anything from anyone who accepted any public benefit, whether a social security check, “land bank” payments for not growing crops, sending their children to public schools, or (of course) borrowing books from the public library (and returning them).

Some libertarians claim that it is moral to steal from the library, or any other government entity, because their assets all come from taxation, and taxation is theft. When you steal a library book, you only take back what was yours in the first place. This also applies by extension to stealing back what was yours from any business that benefits from government subsidies, whether General Motors or Tesla, Inc., a local hospital, or the florist whom you spot coming from the library.

Moving right along, for a philosophical Objectivist (or simply an “admirer” of the works of Ayn Rand), such justifications extend to their irrational mystical altruist collectivist neighbors. The theory is that anyone who goes to church or votes for Democrats is fair game, especially when the risks are very low.  Your neighbors who are tax looters or welfare moochers stole from you first; you are just taking back what was yours. If you can get away with it, why not?


Among the many accurate and precise tools of logic that Ayn Rand employed in her expositions was identifying the error of context dropping. In terms of the social consequences of personal morality, it is the error of moral equivalency. It also a powerful tool in Objectivism that moral success begins in metaphysics and epistemology.  So the moral failing of the looter of the library begins with errors in metaphysics and epistemology. Ayn Rand called it “reifying the zero” i.e., attempting to make a “something” out of nothing.  (See “Axiomatic Concepts” in Introduction to Objectivist Epistemology.) Stealing a copy of Atlas Shrugged from the library is not the moral equivalent of buying one from a bookstore.

The primary concern is not whether the owner of the bookstore sends her children to a government-subsidized daycare center, but where you got the money with which you bought the book.  If you did not buy the book at all, if there was no earned money exchanged, then the failure was yours long antecedent to the gross action of mere acquisition of the book.


It is a perhaps curious fact, revealing the nature of the subject, that generally and historically philosophy is about the individual: you and your place in the universe. Even the weak ones and bad ones attempt some answers to the same question: How do I know what to do? We know many exceptions: Plato’s Republic, the social priesthood of Auguste Comte, Marxism-Leninism, …  But they stand out as exceptions within the 2600-year history of philosophy. Ayn Rand consciously built her philosophy of Objectivism to be the ultimate expression of that discovery: your best experience of your own life.

In Sophocles’ Antigone, the heroine was so outraged by the desecration of her brothers’ bodies, whatever their crimes against the city, that she disobeyed the commands of the tyrant Creon, in full acceptance of the consequences. In The Fountainhead, Howard Roark is prepared to go to prison if he  fails in his appeal to the creative spirit within each of the jurors.  In Atlas Shrugged, Hank Rearden refuses to hand over his metal and tells the government that he cannot stop their trucks and guns if they come to take it. And he is willing to go to prison rather than to acquiesce in the theft of his property.  In Night of January 16th Karen AndrĂ© has committed or conspired in so many crimes that the play does not even come close to a bill of indictment. She makes no appeal to a higher law or a greater good or a better morality. She does not explain herself at all: no outsider’s opinion is consequential to her.


On the other hand, the hooligan who steals a copy of Atlas Shrugged from the public library makes no public statements, issues no manifesto, and stands not in defiance of authority but slinks away with loot.  It might be informative for a bold privateer to wheel several shelving carts out the door while distributing leaflets condemning the philosophical and economic fallacies of “public goods.” (And when the campus police arrive, he should have a clever cloaking device unless he intends to go to jail for his beliefs.) But that is not the case. Instead, other people whose taxes have paid for goods and services are deprived of the benefit of their bargain by a third party. We call that theft.

"Rand fans" are not the only people given to "crimes of conscience." The Roman republican martyr Cato the Younger (Marcus Porcius Cato, Uticensis) became a symbol for Christians and ultimately republicans of the Enlightenment. But, again, Cato the Younger took his own life rather than submit to Gaius Julius Caesar. It remains that the jihadi who kill themselves while they kill others in suicide attacks claim obedience to a higher law, also. But their actions are not  morally equivalent because the consequences are not morally equivalent.

Do you have a duty to obey the law?
 In the explicit sense identified by Ayn Rand, that a duty is an obligation that supersedes self-interest, you do not. But that begs the question: What is self-interest? Rand devoted herself to answering that question. If you do not understand why productively earning the money with which to buy a book is in your self-interest while the easy pickings of the public library are not, you need to do some reading.  It is a common error in our common education that we want even our “story problems” to be short, when in fact, the most important aspects of living well require more than a slogan to explain.

Inspecting the Objectivist Theory of Government


American libertarians generally believe that the only proper functions of government are an army to protect the nation from invasion, police forces to protect citizens from aggression, and courts of law to settle disputes.  That comes directly from Ayn Rand’s essay, “The Nature of Government” published originally in The Objectivist Newsletter (Vol. 2, No. 12, December 1963) and reprinted in The Virtue of Selfishness and Capitalism: the Unknown Ideal.  Beyond that, little work has been done.  When asked in public forums about gun control and capital punishment, Ayn Rand specifically demurred. She had no answers and left it to the future of legal scholarship and jurisprudence.

 The Objectivist theory of government rests on philosophical foundations in ethics, morality, epistemology, and metaphysics.  (Rand conflated ethics and morality. We do so commonly, but they are different.  Morality is personal. Ethics are social.)  Any assertions about what is proper or improper must be consistent with the rational-empiricism of a self-interested individual, whom Rand called man qua man.

Your rights can only be violated by volitional actors, by other people.  If you are injured by a horse, the animal did not violate your rights. The police can only act in retaliation to a violation of rights.  So, if the police see a pack of coyotes surrounding a child, are they morally obligated to act?  (I believe that they are. Others disagree.) If the police know from emergency systems that a tornado is approaching, and if they see picnickers on the public square, are they morally obligated to warn people of the danger?  (I must insist that they do. Others claim laissez faire/laissez passer.) If you have an absolute right to self-determination, and you threaten suicide by jumping from a tall building, are the police obligated to intervene? 

According Ayn Rand, a truly capitalist society depends on government. Government holds a geographic monopoly on the use of retaliatory force.  A government also enforces a single body of law within that geography.  Rand specifically denounced Murray Rothbard’s theory of “anarcho-capitalism” touted later by Linda and Morris Tannehill in The Market for Liberty (1971), and Jarret Wollstein in Society without Coercion (1969) among others.

We had governments before we had police forces.  The word “police” appears nowhere in the U.S. Constitution. The first police force was the London Metropolitan formed by Sir Robert Peel in 1829.  American cities followed. Today Boston, New York, Philadelphia, and Chicago argue about who had the first by whatever definitions that the traditional "night watch" or "fire watch" evolved to copy the London "bobbies."  It was only after the Civil War that the policeman in a blue uniform became an integral part of large cities.  It is also true that the U.S. Marshals were created in the first session of the first Congress. The Judiciary Act of September 24, 1789, established one marshal for each federal district court. (Image at the Library of Congress here.)  The distinction may make a difference.

Today, we have private companies providing police services, armies, adjudication, negotiation, and arbitration, and doing so in competition and cooperation with each other and in competition and cooperation with traditional nation-state governments. These market entities create their own laws, such as the Uniform Commercial Code.  Businesses and individuals also choose among governments, shopping for laws. Read your mortgage, the bank loan for your car, the terms of your credit cards. It is how a Japanese company, buys parts made in Ireland, by a company headquartered in Germany for installation in cars made in Ohio, to be sold by a dealer in Indiana to a customer from Kentucky. And if pirates in the South China Sea hijack the cargo, the owners will call on a private company to retrieve their property.

In 1972, Edwin Newman interviewed Ayn Rand for his show “Speaking Freely” on NBC-TV. Among other statements, Ayn Rand said: “But on the matter of protecting people from physical danger, if certain conditions of employment, let us say, are unsafe and it can be proved that there is a physical risk – I don’t say that we have to wait until somebody dies – then the employer who is creating this risk can be sued, and can be severely punished financially. In other words, there can be a law protecting a man from physical injury by another man. In this case, the employer who puts men into conditions of danger – not accidentally, but intentionally or carelessly – can be penalized because he is infringing the right of his workers not to be injured physically.”  (That and other transcripts are collected in the anthology Objectively Speaking: Ayn Rand Interviewed, edited by Marlene Podritske and Peter Schwartz; Lexington Books, 2009.)

That can bring back the question of the person who threatens suicide. There are many ways to take your own life and rational reasons for doing so; and it is better to face the end under your own control.  But when someone goes to a roof to commit suicide, they are being publicly dramatic. By definition, a person in an irrational state is not capable of making a rational choice.  Anyone in that circumstance has the same legal status as a child.  They get protection they have not asked for.

Discussing these and related problems with other Objectivists I have been accused of being an anarchist, a nanny state progressive, and a totalitarian.  I take that to mean (1) these questions cut to the core of the philosophy; and (2) the problems are not easily resolved; and (3) no one else has a consistent development.

A Visitor from the CIA

Finally catching up on some LinkedIn notices, I saw this.  


I cleaned up the capture to remove a couple of commercial contacts. I noted today's date in the red box to help timestamp the visit.  

Below the CIA is a reference to "Someone in Lansing Community College in the Security and Investigations Industry."  My degrees include an associate's in criminal justice from Washtenaw Community College in Ann Arbor, but I did attend LCC 1973-1990, and taught there part time, 1985-1990.  I never applied for work or sought a contract with the CIA. To write an article about Soviet Computer Technology (Defense Computing, April 1990), I did send a FOIA to the CIA and they were much more forthcoming than was the cultural attache at the USSR embassy.  But that was quite a long time ago.   Make of that what you will.

The Remarkable Story of Risk

Against the Gods: The Remarkable Story of Risk by Peter L. Bernstein explains that the modern world was created by the mathematics of chance.  Earlier times had traders, bankers and merchants.  Our capitalist culture is special because of the mathematics of risk invented by Fermat and Pascal.  Those tools within the Renaissance cultural context allowed the idea that we could - and should - discover and control the future.

I first reviewed this book for the Objectivist Living discussion board hereOver the years I alluded to it occasionally there and on the Rebirth of Reason website. My copy has dozens of Post-its.  Looking through the book again, I made still more notes. Perhaps it is my own ignorance, but hardly a page lacks something important worth marking for future reference. 

These facts, insights, observations, and assertions reflect more than shopping at a supermarket.  After all, von Mises called his work Human Action, not People at the Grocer’s.  “Fear of harm ought to be proportional not merely to the gravity of the harm, but also to the probability of the event.“ (Attributed to the Port Royale Logic.) In criminology, we say that punishment must be “swift, certain, and severe.”  Statistical evidence shows that only certainty seems to prevent crime.

The development of risk theory has deep roots.  Astragalus “knuckle bone” dice are known from Egyptian tombs of 3500 BCE – and pharaoh’s dice were loaded.  But the ancient world had many of the artifacts we assume are modern from accurate astronomy to steam-powered mechanisms.  True enough, the arithmetic was cumbersome, but something else far more consequential was lacking.

“Up until the Renaissance, people perceived the future as little more than a matter of luck or the result of random variations and most of their decisions were driven by instinct.  When the conditions of life are so closely linked to nature, not much is left to human control. As long as the demands of survival limit people to the basic functions of bearing children, growing crops, hunting, fishing, and providing shelter, they are simply unable to conceive of circumstances in which they might be able to influence the outcomes of their decisions.  A penny saved is not a penny earned unless the future is something more than a black hole.” (pg. 18)

From there, Bernstein covers the expected territory of probability theory and statistics: Pascal, Fermat, Graunt, Galton...  Allusions and examples from the American stock markets abound.  While an impassioned capitalist, he is not perfectly consistent in an Objectivist sense, admitting to the need for some government regulation of the financial markets.  However, lowercase-o objectivism runs throughout this work, as it must in any exploration that supports facts with theories and that validates hypotheses with evidence.  Bernstein quotes Chicago economist (and Nobel laureate) Harry Markowitz on diversification: “Diversification is both observed and sensible; a rule of behavior which does not imply the superiority of diversification must be rejected both as a hypothesis and as a maxim.” (pg. 252).

Also my Randian comrades will find it curious that John Maynard Keynes could be quoted as an objectivist: “When once the facts are given which determine our knowledge, what is probable or improbable in these circumstances has been fixed objectively and is independent of our opinion.” (A Treatise on Probability, 1921; cited pg 226.)

Peter Lewyn Bernstein (January 22, 1919 – June 5, 2009) shared his passion for markets with Robert Heilbroner (The Worldly Philosophers) with whom he attended both primary and secondary school, as well as Harvard College. (Biography on Wikipedia here.) Bernstein is also associated with the efficient market hypothesis which says that current prices reflect all the information that is generally available and out-performing the market is impossible without taking on more risk. Bernstein was the first editor of The Journal of Portfolio Management. He authored several books including Capital Ideas: The Improbable Origin of Modern Wall Street.  Bernstein published five of his ten books after he was 75 years of age.

Business Week’s reviewer, Peter Coy, call the theme of risk management “The Closest Thing to a Crystal Ball” (here)  “Bernstein brings Against the Gods up to the present with an account of how some skeptical researchers--beginning with the Israeli-born psychologists Amos Tversky and Daniel Kahneman in the 1950s--trashed the classical model of rationality by exploring how people actually behave in risky situations. The bottom line: People behave irrationally, even when they know they are doing so. Bernstein relates an anecdote about a distinguished Soviet professor of statistics who showed up at an air-raid shelter during a German bombardment. Until then, he had scoffed at the prospect of being hit. What changed his mind?  “Look,'” he explained. “There are 7 million people in Moscow and one elephant. Last night, they got the elephant.”

Harriman's Logical Leap Almost Makes It

The root of the problem with his presentation is that the audience is not defined.  If he were writing only for others in his peer group – he holds master’s degrees in physics and philosophy – then much of Harriman’s narrative could have been deleted.  That the book is mass-marketed indicates a wider audience for whom more or better explanation is needed. Rather than trying to replace the accepted meaning of the inductive method, Harriman should simply call his the objective (or Objectivist) method.

Despite some flaws in the presentation, David Harriman’s proposal for a new method of scientific methodology is interesting, valuable, and important.  Harriman’s thesis is that induction is actually the integration of a new experience with the totality of all previous experience for the purpose of creating a new generalization.  One example is enough for a generalization, if it is validly composed.  According to Harriman, to be valid, an induction must be derived from a first-level generalization.  To demonstrate the truth of his claim, Harriman provides examples from the works of Galileo, Newton, and Dalton, among others.

In philosophy the “problem of induction” is defined by the question “How much evidence is enough?”  David Harriman’s answer is provocative on several grounds.  One fact is enough to validate a theory, if that fact is properly integrated with everything else known to be true.  That much alone would be challenging.  The back cover of this book credits Ayn Rand’s theory of epistemology as the starting point for Harriman’s work.  That flag is necessary for those who do not know Leonard Peikoff as Ayn Rand’s appointed “intellectual heir.”  Peikoff wrote the introduction, and, it is revealed, tutored Harriman in the use of induction in physics.  But Peikoff is a philosopher (doctorate from NYU) and so Harriman attempts the technical proof.

David Harriman is not the only working physicist to blunder about orbital mechanics.  It is an easy error to say that the path of a projectile is a parabola (p. 50).  Later, discussing Newton he does note that the path of an object in orbit under an inverse-square law of central force motion can be any conic section (though he leaves out the line). However, in this part he is explicit about the parabolic path of a projectile. Thirty years ago, I caught Scientific American in this same error; and for them, I photocopied a page from The Wonders of Physics by Irving Adler (Golden Books, 1966).

We take the parabola as an approximation for projectile motion by assuming that the Earth is flat. 

This is helpful to students for whom the mathematics of this curve is easier than that of an ellipse.  The ellipse is the most common orbital path in our immediate experience.  Harriman does not distinguish this.

If projectile motion can be explained to a child, then it should stated correctly in a technical treatise on the epistemology of science. 

This oversight is especially significant as the author claims to be explaining how the scientific revolution of the Renaissance replaced earlier mysticisms.  Galileo knew that the Earth is round; that fact was known to Aristotle.  The diameter of the Earth was measured by Eratosthenes. 

Galileo failed to make the logical leap that Newton finally did when he demonstrated via his calculus why an inverse-square force results in orbits that are conic sections.  In fact, in his introductions to editions of the Principia, Newton credits the ancients (“Chaldeans”) who “long ago believed that the planets revolve in nearly concentric orbits, around the sun and that comets do so in extremely eccentric orbits…” (Cohen/Whitman translation, 1999).

Newton’s works are prominent in this book, and rightfully so.  Newton was arguably the greatest scientist of all time.  However, Newton maintained that light consists of corpuscles; but Newton’s own experiments with optics argued against his theory of light.  Newton maintained faith in a hypothesis that he could not prove.  Harriman glides past this problem (pp. 50-67).  Later, Harriman derides the “wavicle” of modern physics.  He also denigrates Rene Descartes.  As an Objectivist, Harriman is opposed to Cartesian rationalism.  However, Descartes is credited with proving that light refracts according to the ratio of the sines of the angles of incidence and refraction.  In American schools, we call this “Snell’s Law” but Willebrord Snellius did not publish it.  So, Descartes is credited with the independent discovery that sin(I)/sin(R) = k.  Pierre de Fermat also proved this mathematically (rationalistically) from the principle of least time. 

Just as we speak too easily of parabolic motion, so, too, do we accept “white light.”  No such thing exists.  All electromagnetic phenomena exist in discrete wavelengths and white is not one of them.  It is true that if we project a mix of colors (red, blue, green; magenta, cyan, yellow) on a white screen, the screen remains white.  Projecting only a beam of red light on a white screen, the illuminated area appears red.  The perception of “white” is a consequence of perceiving several colors at once.  Harriman uses vernacular English to praise Newton for discovering that white light is composed of colors.

Attempting to explain the development of the atomic theory, Harriman offers an erroneous simile comparing a hydraulic pump to a lever (pp. 123-124).  Explaining the theory of the fluid barometer, he writes: “It is similar to the action of a lever; the weight of the air will raise the same weight of water (per unit surface area).  Here the weight of the entire atmosphere above a particular surface must be equal to the weight of thirty-four feet of water over the surface.”  It is true that all simple machines -- wedge, lever, wheel, axle, and screw – allow us to trade force, distance, time, speed, or work.  Considering conservation of energy, the liquid barometer could be likened to any of them, but it would be stretching the analogy.  A lever works by trading force and distance: the fifty-pound child at the end of a teeter-totter lifts the 150-lb. man sitting on the other side but closer to the center.  The hydraulic lift is not a lever any more than a screw is a pulley.

Harriman states in words what would be easier given as symbols.  Numbers are written out.  This reflects the lack of a defined audience.  Harriman explains some things but glosses over others; and it is hard to know when he is being technical or vernacular. 

Consider the allusions to elastic and inelastic collisions.  “… [Newton] deliberately varied the mass of the bobs and thereby proved that his law applied to both elastic and inelastic collisions.” (p. 127)  Referring to the standard college textbook by Sears and Zemansky (now 
Young and Freedman, Sears and Zemansky’s University Physics), in a perfectly inelastic collision the two bodies stick together, their kinetic energies before and after are not conserved, and the difference lost is converted to heat.  I believe that here Harriman is using the word “elastic” in its vernacular sense: balls of yarn or wood were deformed more or less by the impacts, having negligible consequences to the experiment.  However, discussing the kinetic theory of gases, Harriman uses elastic and inelastic in their proper technical senses (p. 166).

Kepler suggested that perhaps the sun attracts the planets with some kind of magnetism.  Newton ruled out magnetism in Corollary 5 to Proposition VI Theorem VI in the Principia.  However, magnetism had to be considered.  Newton’s measurements suggested that the power of magnetic attraction diminishes at a proportion between an inverse-square and an inverse-cube.  Today, we know that the field of a magnetic dipole diminishes as the inverse-cube, but that the force of attraction toward either pole follows the inverse-square rule.  Thus, gravity, static charge, and magnetism all were contenders to explain the motions of the moon and the falling apple.  As Harriman notes:  “Different causes can lead to qualitatively similar effects (e.g., a magnet with an electric charge on its surface will attract both straw and iron filings, but for different reasons” (p. 137).  But Harriman is in error when he continues: “However, when Newton proves that the moon and the apple fall with rates that were precisely in accordance with a force that varies as the inverse square of the distance from Earth’s center – then there can be no doubt that the same cause is at work” (p. 137).  Strictly on the basis of the inverse-square attraction, both magnetism and electric charge could have been the cause. 

Harriman says that Newton experimented with magnets floated on wood in a tub of water.  According to Harriman, that the magnets were mutually attracted without causing a net motion of the tub proved that the attractions were directed equal and opposite to each other (pp. 127-128).  That experiment proves nothing of the sort.  Placing the magnets in a tub of water and measuring their motions, one might discover several facts, for instance, that some materials magnetize more strongly than others or (counterfactually) that different objects are attracted with unequal accelerations.  But there is no way that they could move the tub, even if they banged into the sides.  It is a standard problem in freshman physics to determine whether a person standing on a (frictionless) rail car could move it by firing a bullet at an opposite wall. 

Harriman goes on to say
“Since Earth attracts all materials on its surface, it was reasonable to suppose (and it would later be proven) that every part of Earth attracts all other parts.  So consider the mutual attraction, say, of Asia and South America.  If these two forces were not equal and opposite, there would be a net force on Earth as a whole – and hence Earth would cause itself to accelerate.  This self-acceleration would continue indefinitely and lead to disturbances in Earth’s orbit” (p. 128).
  Again, Asia might be more strongly attracted to South America than that continent is to Asia.  All actions would take place on the “tub” of the Earth within the same inertial frame of reference.

Denigrating ancient and medieval astronomy, Harriman claims that the relative sizes of the orbits of the planets could not be computed (pp. 88-86).  This was not true; and Harriman must know that because he says that Ptolemy estimated the distance to the stars (p. 88).  Moreover, if it is true that the geocentric model prevents such calculations, then the ancient astronomers must have used some other model, because the relative sizes of the orbits were computed.  The ancients did not believe that all of the celestial lights were spread on a single sphere.  They knew that the moon is much closer than Saturn.  On the other hand, (more reasonably) the geometry and observations of the time did, indeed, allow them to make those calculations, even assuming the geocentric model.  In fact, because of the religious viewpoint, the very scale of the measurable universe and the comparatively small size of the (spherical; not flat) Earth, were substantiating evidence of the relative unimportance of Earthly affairs.  (See Astronomies and Cultures in Early Medieval Europe by Stephen McCluskey, Cambridge, 1998.)

Measurement was always important to the medieval astronomers who welcomed the new astrolabe imported from the Muslims.  Thus, it is no surprise that measurement of the Earth’s diameter and the distance to the moon were important to Sir Isaac Newton.  Harriman says that Newton accepted the numerical approximation of 60 Earth radii as the distance to the Moon (pp. 136-137).  In fact, Newton was not comfortable with these approximations, but he had to settle for them.  He was being stonewalled by John Flamsteed, the Royal Astronomer who also was working out the celestial mechanics of the Earth-Moon system and did not want to share his data.  These facts about Newton are in the standard modern biographies by Richard Westfall (Never at Rest), Michael White (Isaac Newton: the Last Sorcerer), and David Berlinski (Newton’s Gift: How Sir Isaac Newton Unlocked the System of the World.). 

Harriman has his own new theory of science, dismissing the accepted scientific method. 
“Today, it is almost universally held that the process of theory creation is nonobjective.  According to the most common view, which is institutionalized in the so-called “hypothetico-deductive method,” it is only the testing of theories (i.e., comparing predictions to observations) that gives science any claim to objectivity.  Unfortunately, say the advocates of this method, such testing cannot result in proof – and it cannot result even in disproof, since any theory can be saved from an inconvenient observation merely by adding more arbitrary hypotheses.  So the hypothetico-deductive method leads invariably to skepticism” (pp. 145-146). 
 Thus, to Harriman, Newton’s experiments did not validate Descartes’ (more correct) theory of light.

Harriman would do well to heed his own words.  “Introspection is clearly an indispensable source of data, since philosophy studies consciousness and an individual has direct access only to his own” (p. 233).  We have the introspective reports of Richard Feynman, Kary Mullis, Albert Einstein, Francis Crick and James D. Watson, and many others, all of whom report something different in their heads than what Harriman claims must be true of all humans, based, we can assume, on his own introspection. 

Richard Feynman’s The Character of Physical Law delivers an outstanding explanation of why the hypothetico-deductive method works.  Norman W. Edmund, the founder of Edmund Scientifics Corporation, created a superb website at www.scientificmethod.com/.  He teaches a 14-step process which touches on philosophy.  Any public school science teacher knows the many posters and other aids that present a 5 or 9-step method.  Regardless of the specifics, Harriman mischaracterizes the scientific method when he claims that it indulges in rationalist fantasies (p. 142). It is true that you can “make up” any airy explanations you want, but the only ones that count are the ones that can be tested.  Harriman ignores that. 

Arguing in the grand style of Ayn Rand he broadly accuses an unnamed collective of committing evils, and then draws his own conclusions about what they really believe.  “Today, it is almost universally held that the process of theory creation is nonobjective [p. 142].”  He does later resort to the Randian device of naming evil professors such as Paul Feyerabend, but nowhere does Harriman provide any support for his claim that what he opposes is “almost universally held.” 

For Ayn Rand, a person’s fundamental existential choice – to be or not to be – is to think or not to think.  Choosing to think is the essence of being human.  That raises the challenge, “Are you not thinking when you choose not to think?”  Rand’s answer came via psychologist Nathaniel Branden (at first an Objectivist himself, then developing his own Biocentric theories).  Psychological suppression is an avoidance mechanism to prevent unpleasant thoughts.  The thought process is abandoned before the thought can be fully formed.  This can begin as denial, justification, or rationalization, but typically is an emotional precognitive response to a potentially painful identification. 

Similarly, Harriman’s Objectivist theory of induction apparently rests on the very hypothetico-deductive method that he denies: in order to make a logical leap, do you not first carry out a series of experiments, any one of which could falsify the previous work until a better theory explains both?  Harriman praises Galileo and Newton both for their careful and repetitive work.  Then, he denies the repetitive aspect of induction, claiming that these scientists “leapt” to valid conclusions.  Harriman needs a meta-explanation. 

Is it inherent in human nature to think by induction?  Is this why we have superstitions as well as science because we leap to general conclusions based on single instances?  If so, what is the nature of this abstracting?  Where in the brain does it occur?  What chemicals cause it?  Can you go through life never doing it?  Or must you always do it?

Moreover, the hypothetico-deductive method is how we validate and verify the works of others.  Explanatory theories are easy to devise.  To be scientific an explanation must be tested.  The claim, no matter how compelling it seems, must be tried against new data, not in the original set.  And, best of all, a valid theory leads to new predictions not in the original data.  

Harriman requires that to be valid an induction must be integrated with all previously known truths.  If that alone were enough, then any theory might be falsified by the discovery of a new phenomenon.  That brings us back to the very problem Harriman claims to solve.  He wants to avoid the debilitating skepticism that hobbles philosophers of science.  We can never be sure of anything (they say) because something new might come along.  Thus, (it is claimed) science leads not to truth but to ignorance.  

Harriman’s beast is personalized by Paul Feyerabend.  Having recently completed a bachelor of science degree in criminology, I was assigned to read similar “post modernist” claims that there is no such thing as science, but only a “scientistic discourse” that excludes women and minorities, that criminology is only ideology in service to oppression.  Fortunately, our courts do not work on that theory any more than researchers in physics adhere to the "fashionable nonsense" of post-modernism.

While these shortcomings are bothersome, they are not fatal.  Harriman’s thesis deserves more than mere consideration.  Properly taught, it would be a revolution in science.  

Rather than trying to replace the accepted meaning of the inductive method, Harriman should simply call his the objective (or Objectivist) method. 

Objectivism (with or without the capital-O) is rational-empiricism and both sides of that equation are required.  Ayn Rand taught that existence exists, that reality is real, that A is A, entities have identities: to be is to be something.  Therefore, contradictions do not exist.  

Truth is rational and empirical, logical and evidentiary, analytic and synthetic, theoretical and experimental, ideal and practical, deductive and inductive, and even imaginary and experiential. Harriman’s book rests on those truths.  In that, its value cannot be overestimated.

Junk Criminology as Pseudo-Science

Writing about the so-called "CSI Effect" Gregg Barack, Young Kim, and Donald Shelton focused on jurors.  Among the many challenging discoveries of their statistically valid investigation was the fact that less-educated people demand more physical evidence. The "CSI Effect" also runs strongly within professional criminal justice. 


Since the declaration of scientific criminology in the 19th century, police and prosecutors have sought out empirical evidence, relying on what were then new sciences such as  chemistry.  Cesare Lombroso claimed that scientific measurements could identify congenital  criminals. Dactylography (fingerprinting), graphology (handwriting analysis), polygraphs (lie detectors), and psychological profiling, were joined by laboratory analysis of fibers, hair, tissue, cloth, paper, ink, tire treads, shoe prints, typewriter keys, and just about everything else.

Sir Arthur Conan Doyle's Sherlock Holmes in the Strand Magazine became the public's model detective.  Not a mere rationalist Holmes's theories began with empirical evidence.  He studied cigar ashes. In his day, the electron was a theory.  Fifty years later high school students accepted it as basic knowledge.  Today, surgeons are guided by images created by positrons, the anti-matter analog of the electron.  Humans have been to the Moon; our cellphones depend on satellites.  We clone animals and  genetically modify vegetables.  It is not surprising that through this century, empirical evidence from the police laboratory is expected to reveal and convict perpetrators.  But not all science fiction becomes science fact. 

Shoe prints, tire prints, fiber analysis, hair analysis, handwriting analysis, and even fingerprints, all  lack scientific validation.  Scientific truths are statistically valid, large sample, peer-reviewed reports tested by double-blind experiments, explained by coherent theory for which there exists a standard of falsifiability.  The scientific method can be explained as three steps or 14, but it is always the creation and testing of a hypothesis by empirical methods.  A scientific truth is both rational (logically consistent) and empirical (known by perception).  


In the United States, the "Daubert Standard" amplifies and reinforces the Federal Rules of Evidence.  Flooded with expert witnesses in complicated civil and criminal cases, the courts needed a method for differentiating accomplished researchers in esoteric fields from charlatans.  It is bad enough that among the general public those who are less educated expect evidence that they are not equipped to evaluate.  The "CSI Effect" also runs strongly within the profession of criminal justice.  


 The "Criminology and Justice" blog (here) formed by European professionals centered on the Balearic Criminological Society has a recent series of "CSI" articles.  The latest touts the forensic efficacy of shoe prints.  Another is about the value of the forensic sketch artist.  It is true that a complete matrix of evidence can place the perpetrator with the victim at the time of the event.  It is also true that there exists no scientifically valid database of shoe prints; and police sketches of alleged assailants have been elements in wrongful convictions. These professional criminologists cannot differentiate rational-empirical methodology from pseudo-science.  And that is a crime.
